Disclaimer, Waiver, and Release

At Chai Travel Group, we strive to make every travel experience unparalleled. Although we are by your side from the moment you leave your home to the moment you return, we have no control over unforeseeable circumstances that may impact your travel. For example, Chai Travel Group, and your travel advisor, (“Chai”) have no control over, and are not responsible for, the circumstances resulting from, and measures taken in response to world events that may impact your travel, including but not limited to, the Covid-19 pandemic (“Pandemic”). Furthermore, Chai has no control over, and is not responsible for, inclement weather, natural disasters, or mechanical issues with any means of transportation (including but not limited to airplanes, cruise ships, or ground transportation). Finally, we do not directly provide the travel or travel-related services (i.e., air, hotel, ground transportation, cruise, tours) you purchase – our supplier partners do. We partner with well-established suppliers that have a track record of success and delivering excellent service. But sometimes those suppliers impose unexpected changes that may impact your travel. Chai is not responsible for those changes and therefore cannot, and does not, guarantee that such changes will not impact your travel or your overall experience. 

In consideration of the above, by making any payment toward, or engaging in, the travel or travel-related services requested, and in consideration of Chai accepting and facilitating your travel reservation, you hereby acknowledge, accept, agree, and consent to the following: 

  1. Due to the Pandemic or other events outside the control of Chai, the travel services you have requested may be interrupted or cancelled by the suppliers of such services, a government entity, or another third-party outside of Chai’s control for reasons that are foreseeable or possibly unforeseeable at this time.  

  2. Traveling during the Pandemic involves some risk of a variety of hazards to the health and/or safety of yourself and persons who you are traveling with.  These hazards include, but are not limited to, injury, illness, and disease. I understand that I assume all risks associated with travel, whether or not specified here. I further understand that Chai has no control over its’ suppliers’ policies which, in addition to applicable law, will solely govern any cancellation, rebooking, and refund related to the travel services I have requested.  

  3. Chai has no control over, nor is responsible for: terrorist acts, social or labor unrest, mechanical or structural integrity of suppliers, disease, public health emergency, pandemic, border closure, no-travel advisory, political turmoil, local law, a natural disaster, Acts of God, changes, or cancellation of travel due to weather conditions, accidents or health related injuries or any other acts, omissions, or conditions outside of Chai’s control (“Unforeseeable Circumstances”). 

  4. Chai is not the source or supplier of the travel or travel-related services you have requested and is acting solely as an agent for the actual suppliers of such services.  The suppliers appearing in the travel documents and/or information you have received are solely responsible for providing the travel or travel-related services you have purchased. Knowing this, you specifically consent to and request the use of those particular suppliers.  Accordingly, Chai has no control over, and to the fullest extent permitted by law, is not responsible should any of these suppliers, without limitation: i) fail to provide the travel services I have purchased; ii) claim bankruptcy; iii) cease to operate; iv) breach a contract; v) fail to honor a promised credit; vi) fail to comply with any applicable law; or vii) engage in any act or omission that causes me any sort of direct, indirect, special, punitive or consequential damage, loss, delay, inconvenience or injury (collectively, “Supplier Defaults”). 

  5. Every person in your group traveling to any destination outside of their home nation must be able to present a passport that is valid for at least six months beyond the expected date of return. Additionally, some countries may require a visa for transit or entry.  In this regard, you have had the opportunity to review any country-specific requirements at the State Department website found here.

  6. The Department of State also maintains a database of travel advisories and warnings, accessible via the internet here. You have had the opportunity to review this database and, through engaging in travel to a destination for which a warning or advisory exists, you have assumed the risk of such travel. 

  7. The purchase of travel insurance is highly recommended and that coverage for the Pandemic, any of the Unforeseeable Circumstances, or Supplier Defaults, if any, depends on the specific policy I purchase. Should you elect to obtain coverage, the travel insurance policy you obtain to cover the travel or travel-related services you have requested will exclusively dictate any coverage for Damages (as subsequently defined) arising out of, relating to, resulting from, in connection with, or on account of the Pandemic, Unforeseeable Circumstances, and Supplier Defaults.  

  8. The use of a credit card to purchase the travel or travel-related services is also highly recommended as this may offer you the opportunity to dispute the charge(s) or initiate a chargeback for the circumstances enumerated above (i.e., the Pandemic, Unforeseeable Circumstances, and Supplier Defaults). However, it will be ultimately be the credit card company that exclusively dictates and handles the dispute and chargeback process. 

Fully knowing the travel risks set out above, you nevertheless freely and voluntarily assume the risks involved in booking travel and travel-related services through Chai and acknowledge that the Pandemic, Unforeseeable Circumstances and Supplier defaults are risks I may face and that Chai has advised you to purchase travel insurance and purchase travel or travel-related service using my credit card to be able mitigate these risks. 

In light of all of the above, and in consideration of Chai agreeing to facilitate my travel reservations, you agree that, to the extent permitted by law, you hereby release and agree not to hold Chai and its subsidiaries and affiliated companies, owners, shareholders, members, directors, employees, independent contractors, agents, representatives, and assigns(“Releasees”) responsible for, nor will you attempt to hold any of the Releasees liable for, any sort of direct, indirect, special, punitive or consequential damage, loss, delay, inconvenience or injury, illness or disease (“Damages”) arising out of, relating to, resulting from, in connection with, or on account of: i) the Pandemic; ii) Unforeseeable Circumstances; (iii) Supplier Defaults; and (iv) the travel insurance policy’s denial of coverage or a credit card company’s resolution of a dispute or chargeback. 

Finally, in the unlikely event Chai is found to be liable for any reason, Chai's aggregate liability will not exceed the commissions Chai collects from the travel or travel-related services you purchased through Chai.
